Three years since the intervention to the BPA, and not the slightest attempt has been made to give back the funds to the rightful owners.

The State Agency for Resolution of Financial Institutions of Andorra (AREB) has illegally blocked assets from former BPA clients, in total approximately 250 million euros. Furthermore, it now intends to request funds from the government of Andorra to deal with the legal costs that its intransigence has generated, due to litigations and complaints from 109 affected clients who are legally supported, and will not give up the fight to get their savings back.

This money, which is being held in possession by the AREB, is deposited in Vall Banc and banks in Switzerland. Suspiciously enough, it is generating millions in interests to cover the “gone-bad business” of selling the “good” funds to the vulture fund JC Flowers. This entity is the only one profiting from it, and keeps blocking and evading proceedings in order to hold on to the money as long as possible, with no visible intention of giving back the funds to the rightful owners. Just four of the important clients represent an estimated amount of 50 million euros, and the average amount of each of the remaining blocked clients totals over 2 million euros.

With this whole situation going nowhere, BPA clients have filed a lawsuit against the Principality of Andorra through the law firm Cremades-Calvo Sotelo and two other independent Andorran firms. The claim is for an estimated total of nearly 250 million euros. There are 109 legal proceedings being disputed, both civil and criminal, that are related to the BPA resolution and the accounts and products not being transferred to Vall Banc, because of the risk they represented with regard to money laundering.

In an insane and desperate move, the Government submitted a bill on credit supplement that authorized 2.9 million euros to pay for the AREB’s administrative and legal costs as a result of the BPA resolution process. It was stipulated that any income derived from the bridge entity, would be destined to recover all the expenses incurred by the AREB. It is worth mentioning that the Resolution Law includes an initial and extraordinary budget of thirty million euros, provided by bank institutions of Andorra, and also the opening of a financing programme for up to one hundred million euros, meant for the funding of business enterprises.

After taking on the responsibility for the BPA, the AREB has always shown lack of both planning ability and respect for the legal safety of the affected clients, who have pointed out that this aggressive behavior has violated the constitutional right to private property and has jeopardized the image as well as the credibility of the Principality of Andorra. In over three years, no explanation has been given to them on why an entity, that met all national and European standards for norms and protocols, was intervened overnight, blocking all assets. The FinCEN’s behavior is considered erratic and unclear, backed by a consulting firm such as PricewaterhouseCoopers (PwC). The criteria followed has little to do with the current regulations in the Principality of Andorra and around the world, and it has prevented many clients from qualifying.

Pese a que las entidades locales, a dos años y medio no han podido encontrar evidencias de que las operaciones de la Banca Privada de Andorra (BPA) en el país estuviesen asociadas con actos ilícitos, los clientes continúan esperando la devolución de sus fondos congelados, que en depósitos y renta fija suman 190 millones de euros, de acuerdo a cálculos oficiales, mientras por parte de la Agencia Estatal de Resolución de Entidades Bancarias (AREB) no hay ningún interés en cerrar este aciago capítulo de la banca internacional.

Ante tantas irregularidades en el proceso, la Alcaldía ha ordenado a la AREB entregar el informe de PricewaterhouseCoopers (PwC) sobre la revisión de cuentas de BPA, luego de darles la razón a los clientes afectados en una sentencia emitida el 6 de febrero pasado, ya que la AREB nunca les comunicó el resultado del análisis de sus cuentas, ni si estaban en condiciones de ser transferidos a Vall Banc, dejándolos en la indefensión, y quizá sea la causa que le haya costado la cabeza al vicepresidente del Consejo de Administración de Vall Banc, Christoph Lieber, quien renunció “voluntariamente” a la entidad el pasado 20 de febrero.

Ahora dicha entidad deberá notificar a los clientes de forma justificada si son aptos para pasar a Vall Banc, adjuntando el mencionado informe. En este sentido destaca que de las sentencias que se han dictado, tres les han dado la razón a los clientes, fundamentado en que la AREB en ningún momento respetó los estándares internacionales en materia de confidencialidad y de protección al ahorro de los clientes.

Desde noviembre de 2016 la AREB, cuyo Consejo de Administración lo encabeza Albert Hinojosa Besoli, fue demandada por los clientes afectados por no haber traspasado sus fondos a Vall Banc y haberlos mantenido bloqueados sin explicarles los motivos. La idea de crear un “banco bueno” con los activos y pasivos legítimos de BPA, podría tener un trasfondo misterioso, debido a que la AREB se ha negado sistemáticamente a realizar acuerdos operativos y hacer más expedita la solución de los activos bloqueados.

De acuerdo a un análisis realizado a la última resolución del 27 de octubre del 2017 del Consejo de Administración de la AREB, por la que se adopta, entre otros, el acuerdo de transmisión secuencial de diferentes activos y pasivos de la extinta entidad bancaria a favor de Vall Banc, cuyo antecedente se sustenta en la Ley 8/2015, en la revisión y análisis de los clientes de BPA se aplicó en todo momento un “enfoque de riesgo”, cuando contradictoriamente dicha Ley destaca que “los accionistas de la entidad serán los primeros en soportar las pérdidas y los costes de los procesos”.

La misma resolución ha definido que los clientes fueron considerados “aptos” cuando, sobre la base de la revisión y del análisis realizadas por PwC respecto de su perfil, no se detectaron indicios de operativa sospechosa. La calificación de “apto” y “no apto”, fue el resultado de la aplicación de la metodología y los procedimientos realizados por PwC, sin embargo, esa calificación pareciera tener juicio de valor o procesal para algunos clientes que no han podido recuperar sus ahorros.

Y aunque la AREB ha detectado nuevos clientes elegibles para su traspaso, negligentemente todo sigue en el escritorio, al no haberles notificado su condición de nuevo cliente de Vall Banc con posterioridad a la fecha de transmisión, mediante comunicaciones escritas individualizadas, a pesar de que BPA puso a disposición de Vall Banc el listado de aquellas cuentas que tenían la consideración de traspasables con sus datos personales incorporados.

Es decir, la AREB no ha cumplido con un proceso transparente, objetivo, competitivo y no discriminatorio, ya que, aunque se ha dado un enorme traslado de clientes, así como varias auditorías para determinar el perfil de los depositantes, aún persiste el congelamiento de ciertos activos en renta variable en un banco suizo.

El último traspaso a Vall Banc, se realizó el 9 de noviembre del año pasado, e incluyó 87 cuentas que corresponden a 45 clientes, con un valor de cinco millones de euros, después de que fueron declarados “aptos”, y se les levantó la sospecha de estar relacionados con los casos de blanqueo por los que el banco fue intervenido el 10 de marzo de 2015.
