“Una mala praxis política provocó la caída de la Banca Privada d’Andorra”

Las zonas oscuras de la caída de la Banca Privada d’Andorra (BPA) no se han podido disipar con el paso de los años, pues ni el mismo Tribunal de Corts ha logrado resolver la causa, a pesar de que en Estados Unidos es un capítulo cerrado; lo cierto es que el caso BPA desveló los mecanismos más perversos del sistema, de gente sin escrúpulos que se sirvieron de las herramientas del “Estado de Derecho” para destrozar la vida de miles de personas.

La intervención de la entidad generó un terremoto financiero en el Principado que provocó la huida de los ahorradores, y puso al borde del abismo a la que hasta hace unos tres años, era una de las principales plazas financieras del mundo, que difícilmente se podrá recuperar del daño que se ha hecho a su reputación.

Los clientes afectados por el estallido de la crisis de BPA y que nunca cometieron ningún tipo de delito, no sólo mantienen sus cuentas congeladas, sino que además siguen sufriendo un acoso tenaz e implacable por parte de las autoridades como la Unidad de Inteligencia Financiera de Andorra (UIFAND), sin embargo, la Fiscalía andorrana no ha querido actuar en relación a costosas propiedades que se ha señalado en medios, posee el director de dicha entidad, Carles Fiñana.

Este es un episodio más de cómo desde el poder se puede pervertir el sistema, sacar mal provecho de las circunstancias y hacer mal uso de las debilidades de quién, en teoría, tienen la potestad en los Tribunales, para que los que son inocentes o incluso víctimas, puedan figurar como los asesinos en serie más peligrosos de toda la historia del mundo.

Hoy se sabe que la justicia de Estados Unidos, luego de desclasificar parte de unos documentos del FinCEN, descubrió que por medio de varios correos electrónicos personal de la agencia estadounidense intentaba contactar con las autoridades andorranas ocho meses antes de que emitiera su famosa “Nota” contra BPA para alertar sobre presuntas malas praxis bancarias. Lo más grave es que dichos documentos que se han hecho públicos, apuntan a una crítica hacia toda la plaza financiera del Principado, donde unas pocas familias de empresarios, tienen una gran ascendencia sobre los órganos de poder.

Por otro lado, la defensa de los accionistas mayoritarios de la entidad transformada hoy en Vall Banc, los hermanos Cierco, ha conseguido avances clave que sustentan su relato sobre la existencia de una presunta mala praxis política que propició la acusación de presunto blanqueo de capitales a nivel internacional y que desde el principio supuso una clara discriminación y arbitrariedad por parte de las autoridades andorranas.

A casi cuatro años, sigue ganando fuerza la tesis que apunta a que el Gobierno, habría dejado caer convenientemente BPA, que estaría afectado por este tipo de prácticas que el FinCEN consideraba ilícitas y que eran legales en ese momento en el país que operaba como un paraíso fiscal, ya que no se había iniciado el proceso para normalizar las relaciones con el regulador europeo.

Toda esta maraña continúa su periplo, en el marco de un proceso electoral en Andorra, que se celebrarán en marzo de 2019, en medio de discrepancias y batallas internas, donde el caso BPA marcará el final del dos veces Ejecutivo del Principado, Antoni Martí, mientras su partido “Demócratas por Andorra”, ha quedado muy tocado por las dudas que pesan sobre la responsabilidad directa en el caso de su todavía líder.

The dark zones in the fall of the Banca Privada d’Andorra (BPA) have not been able to dissipate with the passing of the years, because neither the Court of Corts itself has managed to resolve the case, even though in the United States it is a closed chapter. The truth is that the BPA case unveiled the most perverse mechanisms of the system, of unscrupulous people who used the tools of the “Rule of Law” to destroy the lives of thousands of people.

The intervention of the entity generated a financial earthquake in the Principality that caused the flight of savers, and put them on the edge of the abyss. A principality, that until just about three years agohad been one of the main financial centers of the world, which can hardly be recovered from the damage that has been done to its reputation.

Clients affected by the outbreak of the BPA crisis and who never committed any type of crime, not only still have their accounts frozen, but also continue to suffer tenacious and relentless harassment by authorities, such as the Financial Intelligence Unit of Andorra (UIFAND). However, the Andorran Prosecutor’s Office has not wanted to act in relation to expensive properties that has been indicated in the media, owned by the director of the said entity, CarlesFiñana.

This is one more episode of how power can pervert the system, misuse the circumstances and misuse the weaknesses of who, in theory, have the power in the courts, so that those who are innocent or even victims can appear as the most dangerous serial killers in the history of the world.

Today it is known that the United States justice, after declassifying part of some FinCEN documents, discovered that by means of several personal emails from the US agency, it was trying to contact the Andorran authorities eight months before it issued its famous “Note” against BPA to alert about alleged banking malpractice. The most serious part is that these documents that have been made public, point to a criticism of the entire financial jurisdiction of the Principality, where a few families of entrepreneurs have a great influence on the organs of power.

On the other hand, the defense of the majority shareholders of the entity that transformed today in Vall Banc, the brothers Cierco, has achieved key advances that support their story about the existence of an alleged political malpractice, that led to the accusation of alleged money laundering on international level and that from the beginning involved a clear discrimination and arbitrariness on the part of the Andorran authorities.

Almost four years ago, the thesis continues to gain strength that the government would have conveniently dropped BPA, which would be affected by this type of practices that the FinCEN considered illicit and that were legal at that time in the country that operated as a tax haven, since the process to normalize relations with the European regulator had not been initiated.

All this tangle continues its journey, in the framework of an electoral process in Andorra, to be held in March 2019, amid discrepancies and internal battles, where the BPA case will mark the end of the two-time Executive of the Principality, Antoni Martí, while his party “Democrats for Andorra”, has been very touched by the doubts that weigh on the direct responsibility in the case.
