With 13 open legal proceedings, following the fall of Banca Privadad’Andorra (BPA) for fictitious allegations of money laundering by the US authorities in 2015, the reputational image of the Andorran bank snoops beyond the borders of the Principality, while the affected clients do not remove their finger from the line to claim damages for the almost four years that their investments have been frozen.

Despite the false accusations, Andorran justice never acknowledged the vulnerability of the users and abuse carried out by some banking entities with their clients who were not respected their right to private property, under penalty of having FinCEN withdrew its accusation, without explaining what it was based on to launch it and then remove it.

With a contribution of 21% of the Gross Domestic Product (GDP), 5% of jobs and a volume of assets that reaches 46 billion euros, until a few years ago the banking sector was boosted as the most important for the economy of the Principality (Principado), nevertheless, the catastrophe reached them: Andbank, Morabanc, VallBanc, BancSabadelld’Andorra and CrèditAndorrà, are in red numbers. The latter is going through its worst moment, winning only 25 million in 2018, half of what was expected.

And although last year they desperately made a “road-show” that toured Madrid, London, Paris and Frankfurt, to convey to the investment community that Andorra is no longer a tax haven and its banks compete with the same rules as Europeans, not it reached them to appease the financial tsunami that the same government of Antoni Martí provoked.

Certainly, Andorran banks were never prepared to face the challenge of the end of bank secrecy, while institutional clients outside Andorra have not yet understood the change in the financial system and prefer to entrust their savings with a Spanish or French bank. To the Andorran government “it backfired”.

For its part, the Cremades& Calvo Sotelooffice, continues claiming 366 million euros to the Government of Andorra for the intervention of BPA and the damage caused to 300 customers, derived from the false report of the consultant PricewaterhouseCoopers (PwC) that accused them as suspects of money laundering, although curiously they were never investigated.

On their side, the Cierco brothers, majority shareholders of the defunct bank, opened the door to a new investigation on the economic policies of the Pyrenean country, due to a clear discrimination and arbitrariness in the takeover of BPA, and when it was known today that the Executive of the Principality (Principado) exerted pressure on the institutions in charge to verify the cleanliness of the operations of the entity, among them the regulator INAF.

While time continues its inexorable course, thousands of clients continue to be prevented by a mafia of politicians and corrupt authorities, to withdraw their money, which is already more than proven to be totally legal, facing a terrible obstacle: the great incompetence and concealment of the authorities Andorran financial institutions, such as the State Agency for Resolution of Banking Entities (AREB), headed by Albert Hinojosa Besolí, and the Financial Intelligence Unit of Andorra (UIFAND), headed by CarlesFiñana.

Con 13 procesos judiciales abiertos, tras la caída de Banca Privada d’Andorra (BPA) por acusaciones ficticias de lavado de dinero por parte de las autoridades estadounidenses en 2015, la imagen reputacional de la banca andorrana asquea más allá de las fronteras del Principado, mientras los clientes afectados no quitan el dedo del renglón para reclamar daños y perjuicios por los casi cuatro años que sus inversiones han estado congeladas.

A pesar de los falsos señalamientos, la justicia andorrana nunca reconoció la vulnerabilidad de los usuarios y abuso que llevaron a cabo algunas entidades bancarias con sus clientes a quienes no se le respetó su derecho a la propiedad privada, so pena que el FinCEN retiró su acusación, sin explicar en qué se basó para lanzarla y luego quitarla.

Con una aportación del 21% del Producto Interior Bruto (PIB), el 5% de los empleos y un volumen de activos que alcanza los 46 mil millones de euros, hasta hace unos pocos años el sector bancario se apuntalaba como el más importante para la economía del Principado, sin embargo, la catástrofe los alcanzó: Andbank, Morabanc, VallBanc, BancSabadell d’Andorra y Crèdit Andorrà, se encuentran en números rojos. Este último, atraviesa por su peor momento, al ganar tan solo 25 millones en 2018, la mitad de lo previsto.

Y aunque el año pasado realizaron desesperadamente un “road-show” que recorrió Madrid, Londres, París y Fráncfort, para transmitir a la comunidad inversora que Andorra ya no es un paraíso fiscal y sus bancos compiten con las mismas reglas que los europeos, no les alcanzó para apaciguar el tsunami financiero que el mismo Gobierno de Antoni Martí provocó.

Ciertamente, la banca andorrana nunca estuvo preparada para enfrentar el reto que suponía el fin del secreto bancario, mientras los clientes institucionales fuera de Andorra aún no han entendido el cambio del sistema financiero y prefieren confiar sus ahorros con un banco español o francés. Al gobierno andorrano “le salió el tiro por la culata”.

Por su parte, el despacho Cremades & Calvo Sotelo, sigue reclamando 366 millones de euros al Gobierno de Andorra por la intervención de BPA y el perjuicio causado a 300 clientes, derivado del falso informe de la consultora PricewaterhouseCoopers (PwC) que los palomeó como sospechosos de blanqueo de capitales, aunque curiosamente nunca se les investigó.

De su lado, los hermanos Cierco, accionistas mayoritarios de la extinta banca, abrieron la puerta a una nueva investigación sobre las políticas económicas del país pirenaico, debido a una clara discriminación y arbitrariedad en la toma de control de BPA, y al conocerse hoy que el Ejecutivo del Principado ejerció presión sobre las instituciones encargadas de comprobar la pulcritud de las operaciones de la entidad, entre ellos el regulador INAF.

Mientras el tiempo sigue su inexorable curso, miles de clientes continúan impedidos por una mafia de políticos y autoridades corruptas, para retirar su dinero, que ya está más que demostrado es totalmente legal, enfrentando un terrible escollo: la gran incompetencia y encubrimiento de las autoridades financieras andorranas, como la Agencia Estatal de Resolución de Entidades Bancarias (AREB), encabezada por Albert Hinojosa Besolí, y la Unidad de Inteligencia Financiera de Andorra (UIFAND), encabezada por Carles Fiñana.
