The biggest historical error of the Andorran government was to collaborate with Spain and the United States to sink the Banca Privada d’Andorra (BPA), even though today it has been demonstrated that the justice of the Principality proved nothing that was accused and pointed out. The only thing that was achieved was that the rest of the banks and the financial sector of the country as a whole, remain mortally wounded before the international community and a lost clientele.

Despite the vast resources that Andorran bankers have allocated to improve their image in international public opinion, neither the efforts of the Pyrenean governmenthave managed to reverse this unfortunate history. Justice is still investigating, but without finding responsible for banking practices that have always been tolerated by their legislation and that now claim to be criminalized.

It is a fact that the Machiavellian complicity of the ruinous and servile Andorran Executive in the intervention of the BPA after the note made by FinCEN caused the loss of the main condition of any credit institution: credibility and security in its own place.

The administration led by Antoni Martí, could not defend its own interests without damaging the country’s economy, which puts in doubt its continuity in front of a government sold at the minimum pressure. Together with his finance minister, Jordi Cinca, they will have to explain thoroughly the mess that has been pointed out, they are the direct executors.

Precisely, the Cierco brothers, majority shareholders of BPA until its nationalization, filed an appeal with the bodies of the Council of Europe responsible for the fight against corruption, considering that the process of analysis of bank accounts carried out by the infamous auditing company PricewaterhouseCoopers (PwC) was “arbitrary” and “discriminatory”. Because the process of transferring customers and accounts have resulted in an unfair situation in which there are hundreds of affected customers and who to date cannot dispose of their assets. They agree that everything that happened tothe bank was a political pressure to which the Martí government gave way.

This is compounded by a lawsuit filed in the United States to obtain information about the links between the JC Flowers vulture fund, the entity that was finally awarded the former Andorran bank when it was renamed Vall Banc, and the convertible bonds issued by the entity. They turned out to be a real fiasco.

The lawsuit, which also involves Joan Pau Miquel, former CEO of the entity, is to claim data to demonstrate a thesis based on other data in relation to litigation in another country. The suspicion of the brothers Higini and Ramón Cierco, is that Vall Banc exchanged the debt that it generated with BPA for the transfer of assets with convertible bonds, known as CoCo’s. These bonds were issued by the bank for a value of 70 million euros. It was a way to comply with the solvency requirements imposed by the monetary authorities.

However, the modification of the solvency criteria, the fall in interest rates and the fact that Vall Banc did not pay the holders, caused the plummeting of its value, which opened the doors to JC Flowers to buy the bank for the laughable amount of 12.8 million.

The petition to the US authorities is related to the lawsuit filed in Andorra against the Andorran State, the State Agency for Resolution of Banking Institutions (AREB), headed by Albert Hinojosa Besolí, and the Andorran National Institute of Finance (INAF), headed by Ramón Lopez. Because the creation of the CoCo’s was part of a strategy to empty the bank for the benefit of the vulture fund.

El más grande error histórico del gobierno andorrano fue colaborar con España y con Estados Unidos para hundir a la Banca Privada d’Andorra (BPA), a pesar de que hoy ha quedado demostrado que nada de lo que se acusó y señaló fue comprobado por la justicia del Principado, lo único que se logró fue que el resto de los bancos, el sector financiero del país en conjunto, permanezca herido de muerte ante la comunidad internacional y una clientela perdida.

A pesar de los vastos recursos que los banqueros andorranos han destinado para mejorar su imagen ante la opinión pública internacional, ni los esfuerzos del gobierno pirenaico han logrado darle la vuelta a esta lamentable historia. La justicia sigue investigando, pero sin encontrar responsables de prácticas bancarias toleradas desde siempre por su legislación y que ahora pretenden ser criminalizadas.

Es un hecho que la maquiavélica complicidad del Ejecutivo andorrano, ruin y servil, en la intervención de BPA tras la nota del FinCEN, ocasionó la pérdida de la principal condición de cualquier entidad crediticia que se precie: credibilidad y seguridad en su propia plaza.

La administración que dirige Antoni Martí, no pudo defender sus intereses propios sin dañar la economía del país, lo que pone en duda su continuidad al frente de un gobierno vendido a la mínima presión. Junto con su ministro de Finanzas, Jordi Cinca, deberán explicar a fondo por el lío del que se ha señalado, son los directos ejecutores.

Precisamente, la familia Cierco, accionistas mayoritarios de BPA hasta su nacionalización, presentó un recurso ante los organismos del Consejo de Europa encargados de la lucha contra la corrupción por considerar que el proceso de análisis de cuentas bancarias llevado a cabo por la infame empresa PricewaterhouseCoopers (PwC) fue “arbitrario” y “discriminatorio”, porque el proceso de traspaso de clientes y cuentas habría derivado en una situación injusta en la que hay cientos de clientes afectados y que a la fecha no pueden disponer de sus activos. Coinciden que todo lo acontecido sobre su banco fue una presión política a la que cedió el gobierno de Martí.

A esto se suma una demanda presentada en Estados Unidos para obtener información sobre los vínculos entre el fondo buitre JC Flowers, la entidad que finalmente se adjudicó el antiguo banco andorrano cuando pasó a llamarse Vall Banc, y los bonos convertibles emitidos por la entidad y que resultaron ser un verdadero fiasco.

La demanda, en la que también participa Joan Pau Miquel, antiguo CEO de la entidad, consiste en reclamar datos para demostrar una tesis apoyada en otros datos en relación a un litigio en otro país. La sospecha de los hermanos Higinio y Ramón Cierco, radica en que Vall Banc canjeó la deuda que generó con PBA por la cesión de activos con bonos convertibles, conocidos como CoCo’s. Esos bonos fueron emitidos por el banco por un valor de 70 millones de euros. Era una forma de cumplir con los requisitos de solvencia impuestos por las autoridades monetarias.

Sin embargo, la modificación de los criterios de solvencia, la caída de los tipos de interés y el hecho de que Vall Banc no pagaba a los tenedores, provocó la caída en picada de su valor, que abrió las puertas a JC Flowers para que acabara comprando el banco por la risible cantidad de 12,8 millones.

La petición a las autoridades estadounidenses está relacionada con la querella interpuesta en Andorra contra la Agencia Estatal Andorrana de Resolución de Entidades Bancarias (AREB) y el Instituto Nacional Andorrano de Finanzas (INAF), debido a que la creación de los CoCo’s formaba parte de una estrategia para vaciar el banco en beneficio del fondo buitre y que nunca tuvieron el valor que se les dio.
