Vall Banc has not aptly applied the necessary restructuring measures, nor shown stability, despite being one of the best-capitalized banks of Andorra. Nor a bank that meets the desires and expectations of its clients, since it has not offered any personalized financial solutions and strategies. In addition, their digital services of the private banking division is a real fiasco.

Its principle of ethics and of absolute integrity, as they preach, has been inconsistent in acting irresponsibly and dishonest according to the interests of its clients and partners. Its CEO, Christoph Lieber, has ignored the commitment to provide highest professionalism, accuracy, service and transparency to its clients, partners and owners, and his priority until now has never been to safeguard the assets of the clients.

The new financial entity has not complied strictly with the laws and regulations applicable to its activities; in addition, it has not avoided the risks that can harm its reputation, both on a business and employee level. Despite the fact that each of its specialists in private banking offer their services only to a limited number of clients, the investors have not been given a constant and personalized service, but actually without having any solutions according to the needs and problems of each client.

Vall Banc has not at all been a responsible partner with its private banking portfolio, for not having acted reliably and with discretion in the best interests of the clients, without offering them any opportunities, and avoiding unforeseeable risks to their patrimony and family businesses.

In the area of investment advice for those clients who prefer to decide for themselves how to make their investments, they have not complied with the specific provisions made exclusively through agreements. Not at all been collaborative, nor have they developed an investment strategy adapted to the individual expectations of risk and profitability of each affected client. In addition, it is a vicious lie that all decisions remain in the hands of its clients, who at no time have benefited from their supposed independence and strict neutrality.

Despite the fact that the CEO of the vulture fund, J. Christopher Flowers, showed his commitment to help the clients affected by the financial center of reference, during his meeting with the prime minister Antoni Martí, no strategy has been implemented so far to help get out of the rut that Vall Banc is currently in.

“We will help transform the bank, to become leader, by its results, innovation and services. In the next coming months, Vall Banc will expand its services, and clients will begin to see substantial improvements in their interaction with the bank,” did J. Christopher Flowers say last September 5, but the promises have now simply remained as part of the speech. His urge to encourage the team of Vall Banc, headed by its president Michael Christner, to maintain the effort and to work without a break for the full restoration of services and the operative, has ran into a wall.

All this has led to an absolute distrust in the Andorran financial system, since there has been no provision for J.C. Flowers to help contribute in boosting the country as a financial center of reference. So his speech of wanting to “have a prominent role in rebuilding the reputation of Andorra as a major European financial center”, has been left in tatters.

Although the Prime Minister, Toni Martí, has said, that the government has hired experts to evaluate the measures and that it is being worked on in this way, after having appeared before the special legislative committee, which deals with the case of BPA. The reality is that the situation is very complicated for savers, and it will further complicate if the General Council finally approves the law of automatic exchange of tax information that will trade in force as of January 1 of 2017. This means that the data of the balances for the accounts of foreigners in BPA and Vall Banc will automatically be communicated to the tax authorities in Spain, France, and the rest the countries in the OECD.

In the case of accounts in excess of 1 million euros, the thousands of foreign clients of BPA and Vall Banc will have to close their accounts in the country of the Pyrenees before the end of this year if they want to avoid the exchange of tax information. Apart, Vall Banc would have to unlock the current balances in dollars and the variable interest rate portfolios immediately so that the clients will have enough time to gain access to their savings in the American currency.

Time passes and if Vall Banc does not resolve the demands of thousands of clients who want to recover their capital, it could get a very serious sanction, including its imminent closure.

Vall Banc no ha aplicado acertadamente las medidas de reestructuración necesarias, ni mostrado estabilidad, a pesar de ser uno de los bancos mejor capitalizados de Andorra. Tampoco ha sido un banco que cumpla los deseos y expectativas de sus clientes, ya que no ha ofrecido soluciones financieras y estrategias personalizadas, siendo sus servicios digitales de la división de banca privada un verdadero fiasco.

Su principio de ética y de integridad absoluta, como ellos pregonan, para con sus clientes y socios, ha sido incongruente al actuar de forma irresponsable y deshonesta de acuerdo a sus intereses. Su consejero delegado, Christoph Lieber, ha ignorado el compromiso de ofrecer la máxima profesionalidad, precisión, atención y transparencia a sus clientes, socios y propietarios, y su prioridad hasta el momento nunca ha sido salvaguardar sus patrimonios, pues sólo ha privado la desconfianza.

La nueva entidad financiera no ha cumplido estrictamente la legislación y normativas aplicables a sus actividades, además no ha evitado los riesgos que pueden perjudicar a su reputación, tanto a nivel empresa como a cada empleado. A pesar que cada uno de sus especialistas en banca privada presta servicio a un número limitado de clientes, no se ha visto un asesoramiento constante y personalizado de los inversionistas, sin que realmente tengan soluciones, de acuerdo a las necesidades y problemática de cada cliente.

Vall Banc para nada ha sido un socio responsable con su cartera privada, al no actuar en función de los mejores intereses de los clientes de forma fiable y con discreción, sin ofrecerles oportunidades, evitando riesgos imprevisibles para su patrimonio y negocios familiares.

En el rubro de asesoramiento de inversión para aquellos clientes que prefieren decidir por sí mismos cómo realizar sus inversiones, no han cumplido con las disposiciones concretas que se han hecho exclusivamente mediante acuerdos. No han sido para nada colaborativos, ni han desarrollado una estrategia de inversión adaptada a las expectativas individuales de riesgo y rentabilidad de cada cliente afectado. Y es una vil mentira que todas las decisiones quedan en manos de sus clientes, que en ningún momento se han beneficiado de su supuesta independencia y estricta neutralidad.

A pesar de que el consejero delegado del fondo buitre, J. Christopher Flowers, durante su encuentro con el jefe de gobierno Antoni Martí, mostró su compromiso de ayudar a los clientes afectados por la plaza financiera de referencia, hasta el momento no se ha implementado una estrategia que ayude a salir del bache en que se encuentra Vall Banc.

“Ayudaremos a transformar el banco, para que sea líder, por sus resultados, innovación y servicios. En los próximos meses Vall Banc ampliará su oferta y los clientes empezarán a ver mejoras sustanciales en su interacción con el banco”, habría dicho el pasado 5 de septiembre J. Christopher Flowers, pero simplemente las promesas han quedado en el discurso. Su exhorto de alentar al equipo directivo de Vall Banc, encabezado por su presidente Michael Christner, a mantener los esfuerzos y a trabajar sin pausa para el total restablecimiento de los servicios y la operativa, ha topado con pared.

Todo esto ha provocado una absoluta desconfianza en el sistema financiero andorrano, ya que no ha habido disposición de J.C. Flowers para contribuir a impulsar al país como plaza financiera de referencia, por lo que su discurso de querer “tener una participación destacada en reconstruir la reputación de Andorra como gran centro financiero europeo”, ha quedado por los suelos.

Aunque el jefe del Ejecutivo, Toni Martí, ha dicho, luego de comparecer ante la comisión legislativa especial que trata el caso BPA, que se han contratado a expertos para que evalúen medidas y que se está trabajando en este sentido, la realidad es que la situación se vislumbra muy complicada para los ahorradores, y se complicará más si finalmente el Consejo General aprueba la ley de intercambio automático de datos fiscales que tiene que entrar en vigor a partir del próximo 1 de enero, y que supondrá que los datos sobre los saldos de las cuentas de extranjeros en la BPA y en Vall Banc se tendrán que comunicar automáticamente a las haciendas de España, Francia, y del resto de países de la OCDE.

En el caso de cuentas superiores al millón de euros, el millar de clientes extranjeros de BPA y de Vall Banc tienen que cerrar sus cuentas con el país de los Pirineos antes de que acabe este año si quieren esquivar el intercambio de información fiscal. Vall Banc, a parte, tendría que desbloquear los saldos actuales en dólares y la cartera de renta variable de manera inmediata para que los clientes tengan el tiempo necesario para poder acceder a sus ahorros en la moneda norteamericana.

El tiempo pasa y si Vall Banc no resuelve las demandas de miles de clientes que quieren recuperar sus capitales, podría tener una sanción muy grave, incluso su inminente cierre.
