Luego que el Tribunal Supremo de Justicia de Venezuela cerró el caso contra el ex viceministro de Desarrollo Eléctrico, Nervis Villalobos, que se encontraba acusado por supuesto blanqueo de capitales, que fue la base para la liquidación del Banco Madrid, y la reciente exoneración del exconsejero delegado de Banca Privada d’Andorra (BPA) Joan Pau Miquel, el pasado 16 de enero, tras pasar 22 meses de prisión preventiva, una a una se les caen las acusaciones al Gobierno español en el “Caso BPA”, porque siempre carecieron de fundamentos y se refuerza la teoría que todo se trató de un complot financiero, llevado a cabo a través de una red de complicidades.

Ante estas pifias tanto de las autoridades andorranas como del gobierno de Antonio Martí, la Plataforma de Afectados por BPA, ha desplegado la artillería pesada para contraatacar a la Banca Privada d’Andorra, Vall Banc y el Ejecutivo andorrano, para lo cual varios bufetes de abogados trabajan ya en la elaboración de las denuncias masivas para reclamar el regreso de sus capitales que aún se encuentran “congelados”, así como las correspondientes indemnizaciones por daños y perjuicios. Está muy claro la actitud irresponsable de Vall Banc, que no les permite acceder a su dinero que tenían en BPA, con el beneplácito del Gobierno de Andorra, una triada que ha sido nociva para el sector financiero español y que sienta un mal precedente en la historia de la Banca mundial.

No es coincidencia que apenas el pasado mes de enero Andorra y España comenzaran a intercambiar información sobre cuentas bancarias, y que hacienda empezara a comprobar los datos bancarios de los miles de clientes que tienen ahorros en Andorra.

Lo cierto es que la regularización de cuentas debió hacerse antes del 31 de diciembre del año pasado, por lo que a partir de ahora los afectados pueden ser sancionados por Hacienda si no prueban la procedencia del dinero. La pesadilla que inició hace dos años, parece interminable para ellos, ya que muchos datos los tenía la propia BPA y, en otros, resulta complejo encontrar a alguien con quien analizar la situación punto por punto.

La entrada en vigor el pasado 1 de enero del convenio de intercambio automático de información firmado con el Gobierno español, ha provocado un auténtico caos a miles de españoles que tienen cuentas en la antigua BPA, y que permanecen bloqueadas por el Ejecutivo local. A la fecha, se trata de más de 2 mil 500 personas -la mayor parte españoles- de quienes la justicia andorrana aún mantiene sospechas, pero que los auditores de PricewaterhouseCoopers (PwC) no han podido comprobar en una sola cuenta.

Aún con todo el vendaval que se avecina, el Ejecutivo andorrano sigue empeñado en impedir que las cuentas puedan traspasarse a Vall Banc, que fue quien percibió los activos sanos de BPA. La Plataforma de Afectados, a través de su portavoz Gema Martínez, ha denunciado que son muchos los clientes que, al intentar ponerse al día con la hacienda española, no pudieron hacerlo pues no tenían liquidez para poder pagar la regularización antes del 31 de diciembre pasado. Esto ha obligado a muchos clientes que tienen ahorros en Andorra a efectuar donaciones de sus cuentas a fundaciones, ONG’s o familiares.

Y en una acción totalmente ventajosa el fondo buitre J.C. Flowers, propietario de Vall Banc, aprovecha la situación para hacer negocio, al ofrecer financiación a todas aquellas personas que necesitan el dinero para ajustar cuentas con la “justicia”.

La situación es bastante compleja, el traspaso de cuentas no puede hacerse directamente ya que es el banco quien actúa como responsable jurídico en la compra de bonos y valores, y luego hace la distribución interna en torno a sus clientes.

La espera se vuelve desesperante ya que mientras el AREB ha permitido el traspaso de la mayor parte de las cuentas, Vall Banc ha optado por no atender a los cerca de tres mil clientes y desestimar la problemática, al grado de ignorar las cartas y las llamadas de miles de afectados. Por su parte el Ejecutivo de Andorra todavía no ha sido capaz de dar una fecha concreta; pareciera que no tiene la más mínima intención de que se aclare la situación.

Aunque muchos afectados ya han probado la procedencia licita del dinero, el Gobierno de Andorra insiste en impedir traspasos a la entidad que asumió los activos de BPA, por lo que su intervención para garantizar la continuidad de la operativa de la entidad, proteger a sus clientes y velar por el buen nombre y la integridad de la plaza financiera andorrana, resultó una total farsa.

Desde el comienzo, el caso careció de sustancia procesal al estar fundamentada únicamente en una información publicada por un periódico español, que tiempo después admitió que dicha información era errónea y la retiró de sus archivos digitales.

The pressure on the BPA, Vall Banc and AREB plot continues to grow

One after one, charges are being dropped on the Spanish Government in the “BPA Case”, because it has always lacked the fundamentals. In addition, the theory is strengthened that everything was a conspiracy, carried out through a network of complicity.

In the face of these blunders by both the Andorran authorities and the government of Antonio Martí, the collective affected BPA clients law firm – Plataforma d’Afectats BPA, has deployed ‘heavy artillery’ to fight back the Banco Privada d’Andorra (BPA), Vall Banc and the Andorran management. Several law firms are already working on mass claims to demand the return of funds that are still “frozen”, as well as the corresponding compensation for damages and responsibility. The irresponsible attitude of Vall Banc is very clear, when they do not allow their clients to access the funds earlier deposited with BPA, with consent by the Government of Andorra. A triad that has been harmful to the Spanish financial sector and that sets a bad precedent in the history of the Banking world.

It is not a coincidence that just back in January, Andorra and Spain started exchanging information on bank accounts, and that the tax authorities will begin to check the banking data of the thousands of clients with savings in Andorra.

Certain is that the regularization of accounts should have been made before December 31 of last year, since from now on the affected clients may be sanctioned by the tax authorities if they do not prove the source of funds. The nightmare that started two years ago seems endless, since much of the requested data was already in the possession of the BPA itself, and in general resulting to be very difficult to find someone to analyze the situation point by point.

The trading in force on January 1 of the automatic exchange of information treaty signed with the Spanish Government, has caused a real chaos to thousands of Spaniards who have accounts in the old BPA, and which remain blocked by the local administration. To date, it is more than 2 thousand 500 people – most of them Spanish – of whom the Andorran justice still has suspicions, which the auditors PricewaterhouseCoopers (PwC) have not been able to prove in one single account.

Even with the entire gale that is looming, the Andorran management remains committed to prevent these accounts from being transferred to Vall Banc, which was the entity that perceived the healthy assets of BPA. The Plataforma d’afectats BPA, through its spokesperson Gema Martínez, has reported there are many clients who, while trying to catch up with the Spanish tax authorities, could not do so because they had no liquidity to pay the regularization before December 31. This has forced many customers who have savings in Andorra to donate from their accounts to foundations, NGO’s or family members.

Moreover, in a totally advantageous move, the vulture fund J.C. Flowers, owner of Vall Banc, takes advantage of the situation to do business, by providing funding to all those people who need money to settle accounts with the “justice”.

The situation is quite complex. The transfer of accounts cannot be made directly because it is the bank that acts as legal responsible in the purchase of bonds and securities, and then makes the internal distribution amongst its clients.

The wait becomes maddening, since while AREB has allowed the transfer of most of the accounts, Vall Banc has chosen not to attend the nearly three thousand clients and dismiss the problematic, to the extent of ignoring the letters and calls of thousands of affected clients. In addition, the Andorran management has yet not been able to give a specific date; it seems as if it does not have the slightest intention to clarify the situation.

Although many affected clients have already proven the legitimate origin of their funds, the Andorran Government insists on preventing transfers to the entity that assumed the assets of BPA. In such extend that its intervention to guarantee the continuity of the operation of the entity; to protect its clients and to ensure the good name and integrity of the Andorran financial market, resulted in a total farce.

From the beginning, the case lacked procedural fundament having been based solely on the information published by a Spanish newspaper, that later admitted to the information being wrong and removed it from its media.
