“La mentira y el engaño, le están cobrando hoy la factura al Gobierno de Andorra”

La interrogante de ¿Quién mató a la Banca Privada d’Andorra?, si fueron los antiguos gestores del banco o fue el Gobierno que preside Antoni Martí, sigue resonando en la desprestigiada plaza financiera y que tendría su antecedente en la ya famosa reunión de Bucarets, celebrada en abril de 2014, entre los fiscales anticorrupción José Grinda y Fernando Bermejo, y el director general de la Unidad de Inteligencia Financiera de Andorra (IUFAND), Carles Fiñana, donde se habría firmado la sentencia de muerte de BPA.

A tres años y medio después del infame 10 de marzo del 2015, el otrora paraíso fiscal ya no es fiable, ni transparente para la inversión extranjera. La mentira y el engaño le están cobrando hoy la factura. La sospecha que se trató de una conspiración del imperialismo americano, ante el desaseado proceso de auditoría que realizó la firma PricewaterhouseCoopers (PwC) por encargo del Gobierno del Principado, es casi una certeza, al destaparse operaciones financieras oscuras con mezcla de políticos y policías corruptos.

Curiosamente, un ex abogado de BPA ahora en nómina del gobierno, representó en febrero pasado, la acusación particular ante el Tribunal Constitucional andorrano, en nombre del Ejecutivo, contra 25 directivos y gestores de cuentas de la extinta entidad bancaria, imputados por supuesto blanqueo de capitales. Asimismo, una veintena de procesados se declararon víctimas colaterales de unos intereses ajenos al Estado andorrano, pues la única entidad atacada era BPA, donde presuntamente tendría o habría tenido cuentas la familia de Jordi Pujol Soley.

Muchos actores civiles coinciden que el hundimiento de BPA se dio por la gran incompetencia burocrática, falta de transparencia y encubrimiento de las autoridades financieras andorranas, partícipes y copartícipes, como la Agencia Estatal de Resolución de Entidades Bancarias (AREB) y la UIFAND que se sometieron a intereses mezquinos de los grupos de poder.

Fueron más de 2 mil clientes que no pasaron la auditoría que PwC hizo por encargo del Gobierno del Principado, por la cual cobró cerca de 100 millones de dólares, lo que le ha valido ganarse una mala reputación y perder la confianza de sus clientes. Ante estas irregularidades, cientos de ahorradores se han quedado colgados en el proceso de migración de activos de renta fija de BPA a Vall Banc, la entidad puente que se vendió al fondo buitre estadounidense JC Flowers.

Son muchos los inversores y pequeños accionistas que aún reclaman a la antigua cúpula del banco el reintegro de su dinero que perdieron y el correspondiente a los daños ocasionados tras la intervención y liquidación de la entidad. En tanto los abogados de los afectados exigen que se abra una investigación para determinar si se actuó contra BPA de forma concertada e ilícita en términos procesales.

Sin que hasta el momento se les haya comprobado que cometieron algún tipo de delito -de origen hubo muchas contradicciones en la información que aparece en la nota del FinCEN-, los clientes afectados, provenientes de todas partes del mundo, siguen siendo sometidos a una represiva y abusiva investigación, por lo que seguirán dando batalla ante los tribunales.

Ante lo que consideran un proceso de resolución deficiente y plagado de irregularidades, los hermanos Higini y Ramon Cierco, accionistas mayoritarios de la desaparecida BPA, exigieron recientemente a las autoridades europeas que revisen la “defectuosa transposición” que Andorra hizo de la directiva comunitaria sobre reestructuración y resolución de entidades financieras, que dio lugar a la denominada “ley BPA”, con la que se intervino este banco.

It is something which still resonates within the financial spheres and that has its precedent in the now famous Bucarets reunion, held in April 2014, between the anti-corruption prosecutors José Grinda and Fernando Bermejo, and the general director of the Andorran Financial Intelligence Unit (UIFAND), CarlesFiñana, where BPA’s death sentencewas supposedly signed.

Three and a half years after that infamous March 10, 2015, the once tax haven is no longer trustworthy nor transparent toforeign investment.The lies and deception are making them pay.The suspicion that it was all a conspiracy from the American imperialism, in the eyes of the unclean auditing process performed by the firm PricewaterhouseCoopers (PwC) by request of the Principality’s Government, is almost assured after uncovering several dubious financial operations between corrupt politicians and policemen.

Oddly enough, a former BPA attorney, now on the government’s payroll, represented last February the accusation before the Andorran Constitutional Court, on behalf of the Executive, against 25 directors and managers of accounts from the extinct bank entity, charged with alleged money laundering.Furthermore, around twenty of the accused declared themselves collateral victims of interests originated outside the Andorran State, for the only attacked entity was BPA, where Jordi Pujol Soley’s family allegedly has or had accounts.

Several civilian actors agree that BPA’s fall down came about because of the great bureaucraticincompetence, lack of transparency and covering up by Andorran financial authorities, also because of participants and partners, such as the State Agency for Resolution of Banking Institutions (AREB) and the UIFAND, who gave in to petty interestsfrom the power groups.

More than 2 thousand clients did not pass the PwC auditing process requested by the Principality’s Government. The firm received around 100 million dollars for it, which has earned them a bad reputation and losing the trust of their clients.In light of such irregularities, hundreds of savers were stuck in the migration process of fixed income assets from BPA to Vall Banc, the bridge entity which was sold to the American vulture fund JC Flowers.

Many investors and small shareholders are still claiming to the former bank’s group the recovery of their lost money and the corresponding compensation for the damages caused after the intervention and liquidation of the entity.Meanwhile the victims’ lawyers are demanding an investigation to be opened in order to determine if there was an illegal course of action against the BPA in procedural terms.

As of this moment, there are still no proof of them committing any type of crime – initially, there was a lot of contradictive information in the FinCEN’s note-, which is why the affected clients, from all around the world, who are still being subject to a repressive and abusive investigation, will keep on giving their best fight in the courts.

Reacting to what they consider a deficient resolution process filled with irregularities, the Cierco brothers, Higini and Ramon, major shareholders of the extinct BPA, recently demanded the European authorities to revise the “flawed transposition” made by Andorra, in regards to the community directive addressing the restructuring and resolution of financial entities, which led to the creation of the so called “BPA law”, through which the bank got intervened.
